| This program is exclusively for clients of Realty World America, Inc. (“Realty World) and its franchisees. When you complete the purchase or sale of real estate property through a participating Realty World agent or sales representative in the fifty U.S. states and the District of Columbia, you may earn rewards points.
ENROLL. To enroll in the Realty World Platinum Rewards Program, sign up with a participating Realty World agent or sales representative (collectively “sales representative”). There are no fees or charges to enroll in the Realty World Platinum Rewards Program. Individuals, corporations, groups, and other associated entities are eligible to enroll, each participant may have only one account, and accounts may not be combined. Membership is limited to legal residents of the 50 United States and the District of Columbia who have reached the age of majority in their jurisdictions of residence at time points are accumulated and corporations, groups, or other associated entities that are organized under the laws of the United States or its states or its states with headquarters located within the United States. If member is not an individual, reward points will be issued to corporation, group or entity, and not to an employee of that corporation, group or entity.
POINTS. Points are awarded to a member upon the closing of escrow on his, her, or its purchase or sale of real estate property through a participating Realty World sales representative located in the 50 United States or the District of Columbia (the “Transaction”). No points will be earned for any purchases or sales made prior to enrollment.
REWARDS POINTS WILL BE AWARDED AT THE SOLE DISCRETION OF THE SALES REPRESENTATIVE AND THE AMOUNT OF REWARDS POINTS AWARDED WILL NOT BE BASED ON ANY FORMULA SET BY REALTY WORLD, AND MAY NOT BE BASED ON A FORMULA RELATED TO THE PURCHASE OR SALE PRICE OF THE TRANSACTION. Member must speak to sales representative prior to closing of Transaction to determine the number of rewards points that will be awarded. Rewards points are not transferable. Within fourteen (14) days of the closing of each qualifying Transaction, your sales representative will log the rewards points earned in the Transaction with an online prize fulfillment company and mail the member a document indicating that member’s user name, the number of points earned in the Transaction, and the name and Internet address of the online prize fulfillment website. The member may then log in to the online prize fulfillment website and redeem rewards points for merchandise. The approximate retail value of the merchandise that the points can be redeemed for may vary. Merchandise is subject to offer and availability at prize fulfillment website. Redemption of points, selection and acceptance of merchandise is subject to prize fulfillment website terms and conditions.
Rewards points are valid and redeemable through Partners for Incentives’ website at www.pfi-awards.com. Rewards points are not redeemable for cash or cash equivalent and may not be applied toward payment of any outstanding Realty World or prize fulfillment company account balances, or previous purchases. Rewards points may not be combined with other Realty World promotions or other discounts. No credits or refunds will be issued for any reason after rewards points have been redeemed, including for unused points. The member will be responsible for paying all taxes and fees and may be requested to present photograph identification or other personal information or other documentation of identification in order to redeem the rewards points. The member must redeem the rewards points within one year of the Transaction, or all points will be forfeited and the rewards points will be void. MEMBERSHIP. Membership in and benefits to the Realty World Platinum Rewards Program is offered at the sole discretion of Realty World and Realty World reserves the right, at its sole discretion, to limit, suspend, cancel, discontinue, terminate, change, amend or modify the Realty World Platinum Rewards Program and its Terms and Conditions, in whole or in part, at any time and without notice to Realty World Platinum Rewards Program members (including, but not limited to, our right to expire points, adjust the amount of points earned for each net dollar in purchases or sales made, where applicable, modify reward levels or reward benefits, or change program benefits, partners, conditions of membership, rules for earning, redeeming, or forfeiting points, or rules governing the use of rewards). Realty World reserves the right to terminate or suspend membership or accumulated points due to fraud or misuse. Realty World reserves the right to suspend, terminate or refuse the member current or future membership in the program. The accumulation of points does not entitle members to any vested rights with respect to points, rewards, or program benefits. In accumulating points, members may not rely upon the continued availability of any reward or reward level. Any unspecified expenses related to the enrollment/use of the Realty World Platinum Rewards program are solely the Realty World Platinum Rewards program member's responsibility.
DISCLAIMER OF WARRANTY / LIMITATION ON LIABILITY. Realty World will not be responsible or liable for any injury, loss, claim, damage, or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including without limitation lost profits or lost savings), whether based in contract, tort, strict liability or otherwise, that arises out of or is in any way connected with (a) any use or misuse of the rewards program or the merchandise or services acquired with rewards points, (b) any failure or delay by Realty World, its franchisees, sales representatives, or their employees in connection with the rewards program (including without limitation the use of or inability to use any component of this rewards program), or (c) the performance or non performance by Realty World, its franchisees, sales representatives, or its employees (including but not limited to any failure, delay or error in crediting points to the member account), even if Realty World has been advised of the possibility of damages. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action. If, despite the limitation above, Realty World is found liable for any loss or damage which arises out of or is in any way connected with any of the occurrences described in the limitation above, then its liability will in no event exceed, in total, the sum of US $25.00.
Some states do not allow the limitation of liability, so the limitations above may not apply to the member. Any claim concerning points not accurately credited to the member must be received by Realty World within 30 days of the Transaction. Realty World is not responsible for lost or stolen member rewards points documents or rewards points. The Realty World Platinum Rewards Points Program is offered “as is” and “as available.”
The program is designed for implementation by Realty World franchisees and its sales representatives. Realty World is does not grant any points and is not responsible for issuance of any merchandise redeemed under the program. Merchandise or services acquired by redeeming rewards points may be subject to warranties and limitations from their source, and Realty World provides and offers no additional warranties. Some sales representatives may not participate in the program. Consult your Realty World sales representative to determine if he/she is participating in the program. Any alteration, modification or representation regarding this program by Realty World’s franchisee, its sales representatives or employees without Realty World’s consent may void the program.
MISCELLANEOUS. Realty World’s interpretation or application of the Terms and Conditions of the Realty World Platinum Rewards program shall be binding on members. By enrolling in the Realty World Platinum Rewards Program, you agree to be bound by the full Terms and Conditions stated herein. You also agree to review these Terms and Conditions periodically and shall be bound by any modifications. If you do not accept these Terms and Conditions, or any subsequent modifications, your sole and exclusive remedy is to terminate your membership in the program. These Terms and Conditions make up the entire agreement between us regarding the Realty World Platinum Rewards Program and supersede any prior agreements (whether oral or written). If a court holds any of these
Terms and Conditions unenforceable, the remainder of the Terms and Conditions shall nevertheless remain enforceable. The failure by Realty World or its franchisees to act on any breach of the Terms and Conditions by the member shall not constitute a waiver of Realty World’s right to act with respect to any future breaches.
These Terms and Conditions shall be construed in accordance with, and governed by, the laws of the state of California applicable to contracts entered into by California residents and to be performed within such State without regard to its conflict of law provisions. Any litigation to enforce or interpret the provisions of these Terms and Conditions or the parties’ rights or obligations arising out of these Terms and Conditions or in connection with the REALTY WORLD® PLATINUM REWARDS POINTS PROGRAM shall be maintained only in the courts in Orange County, California and the parties expressly consent to personal jurisdiction in such courts.
